RCVRY Terms of Service

1. Agreement
These terms are a contract between you and [LEGAL ENTITY NAME] ("we", "us") covering your use of the RCVRY app. By creating an account or using the app you accept them. If you do not accept them, do not use the app.
You must be 18 or older to use RCVRY. See section 4.
2. What RCVRY is
RCVRY is a wellness and self-tracking tool. It lets you log recovery therapy sessions, build routines, set goals, and view trends drawn from your own history and from Apple Health.
RCVRY is not a medical device. It is not intended to diagnose, treat, cure, mitigate, or prevent any disease or condition. It has not been evaluated or cleared by the U.S. Food and Drug Administration or by any other regulator.
3. Health and safety — read this
This is the most important section of this agreement.
The therapies RCVRY helps you track — cold water immersion, infrared sauna, red light therapy, PEMF, cryotherapy, and hydrotherapy — carry genuine risk of serious injury or death. These risks include, without limitation: cold shock response and involuntary gasping; drowning; hypothermia; hyperthermia and heat stroke; fainting; dangerous changes in blood pressure; cardiac arrhythmia; heart attack; frostbite and cold burns; and, for cryotherapy, asphyxiation from nitrogen gas.
Consult a qualified physician before beginning any of these practices, especially if you are pregnant, or have or may have any cardiovascular condition, high or low blood pressure, a heart rhythm disorder, respiratory illness, diabetes, a seizure disorder, Raynaud's phenomenon, a circulatory condition, or any implanted medical device such as a pacemaker. PEMF in particular can interfere with implanted electronic devices.
Never immerse yourself in cold water alone. Never use a sauna alone, or after drinking alcohol or taking drugs that affect temperature regulation, blood pressure, or your ability to perceive heat.
The durations, temperatures, targets, schedules, and routines in RCVRY — including any suggested by the app — are general information, not a prescribed protocol and not medical advice. They are not tailored to you. The recovery score, readiness estimate, and trend and correlation views are statistical estimates from your own logged data, not clinical measurements, and they can be wrong. Nothing in the app is a substitute for professional medical advice, diagnosis, or treatment.
Never disregard professional medical advice, or delay seeking it, because of something you read in RCVRY. If you think you are having a medical emergency, call your local emergency number immediately.
You use these therapies entirely at your own risk. You are responsible for your own safety, for staying within your limits, and for stopping immediately if you feel unwell.
4. Age
You must be at least 18 to create an account or use RCVRY, because of the physical risks described in section 3. By using the app you represent that you are 18 or older. If we learn that an account belongs to someone under 18 we will terminate it and delete the data.
5. Your account
You are responsible for keeping your credentials secure and for activity under your account. Tell us promptly at [SUPPORT EMAIL] if you suspect unauthorised use. Provide accurate information, and keep it current. One person per account; do not share it.
6. Your content
The sessions, notes, routines, and selfies you create remain yours. We claim no ownership.
You grant us only the limited licence we need to operate the app for you: to store, back up, and transmit your content so it syncs between your devices. This licence ends when you delete the content or your account.
You are responsible for what you write. Do not use RCVRY to store unlawful content, or content that infringes anyone else's rights.
RCVRY has no public feed, no sharing between users, and no user-visible third-party content. If that changes we will update these terms and add a notice and takedown process.
7. Our content
The app, its design, text, graphics, and the RCVRY name and logo are ours or our licensors', protected by copyright and trade mark law. You may use the app as intended; you may not copy, modify, reverse engineer, resell, or create derivative works from it, except where the law says you may despite this clause.
8. Acceptable use
Do not: break the law with the app; attempt to access another user's data; probe, scan, or attack our infrastructure; interfere with the service; scrape or bulk-extract data; circumvent security or rate limits; or use the app to build a competing product.
9. Availability
We aim to keep RCVRY working, but we do not promise uninterrupted or error-free service. We may change, suspend, or discontinue features. If we discontinue the service altogether we will give you reasonable notice and a way to export your data.
Sync depends on network connectivity and on our infrastructure provider. Keep your own copy of anything you cannot afford to lose — Settings → Export My Data.
10. Disclaimers and limits on liability
To the fullest extent the law allows, RCVRY is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty as to the accuracy of scores, estimates, trends, or correlations.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill. Our total liability arising out of these terms or the app will not exceed the greater of the amount you paid us in the twelve months before the claim, or USD 100.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. If you are a consumer, you keep all rights your local law gives you that a contract cannot take away.
11. Disputes
Governing law: the laws of the State of Arizona, United States, without regard to its conflict-of-laws rules.
You and we agree that any dispute arising out of these terms or out of your use of RCVRY will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and we each consent to the personal jurisdiction of those courts.
If you are a consumer resident somewhere whose law gives you the right to bring proceedings in your local courts, or entitles you to the protection of mandatory provisions of your home law, nothing in this section takes that away.
12. Termination
You may stop using RCVRY and delete your account at any time in Settings → Delete Account.
We may suspend or terminate your account if you materially breach these terms, or if we are required to by law. Except where a serious breach or a legal obligation makes it impossible, we will give you notice and a chance to export your data.
13. Apple
These terms are between you and us, not Apple. Apple has no obligation to provide support for RCVRY. Apple is not responsible for any claim relating to the app, including product liability, any failure to conform to a legal requirement, or a claim under consumer protection or privacy law. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you are not located in a country subject to a US Government embargo or designated a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties. Your use of the app must comply with any applicable third-party terms, including the App Store Terms of Service.
14. Changes
We may update these terms. For material changes we will give notice in the app before they take effect. Continuing to use RCVRY after that means you accept the new terms; if you do not, delete your account.
15. General
If any provision is unenforceable, the rest stands. Our not enforcing something is not a waiver of it. You may not assign these terms; we may, to a successor in the business. These terms and the Privacy Policy are the whole agreement between us about RCVRY.
